Phone Staffer services are offered to businesses, not for personal, family, or household use. A campaign confirmation, order form, or signed agreement may add or replace terms for a particular service. Please review those documents before launch.
1. Agreement and eligibility
These Terms & Conditions ("Terms") are an agreement between Phone Staffer FZE ("Phone Staffer," "we," "us," or "our") and the person or business using our website or services ("Customer," "you," or "your"). By using the website, booking a service, approving a campaign, or accepting an order that references these Terms, you agree to them.
You represent that you are at least 18 and, if acting for a company, authorized to bind that company. If you do not agree, do not use the services. Website browsing alone does not commit a business to a paid campaign; fees begin only as described in an accepted campaign confirmation, order form, or other clear service authorization.
2. Services and the website-lead calling offer
Phone Staffer provides business services that may include remote staff, inbound or outbound calling, campaign setup, website-visitor identification, lead qualification, call reporting, scheduling, and related integrations. The exact scope is stated in the campaign confirmation or order form (together, the "Campaign Confirmation").
The $1 calling-only offer
When a Campaign Confirmation expressly accepts the landing-page offer, Phone Staffer chargesUS $1 for each Qualified Homeowner Lead, billed weekly. For that offer, there is no setup fee, platform fee, deposit, or monthly minimum. The offer includes calling the qualifying leads; it does not include email, postcards, or another follow-up channel unless separately agreed.
- Qualified Homeowner Lead
- A record that reasonably matches to a real homeowner, reflects a visit to a Customer website or configured page, falls within the Customer's configured service area, and is not excluded as bot, test, outside-area, or duplicate traffic under the campaign settings.
- Duplicate
- A record identified by the campaign's reasonable duplicate-detection rules as the same homeowner lead already submitted for charge under that campaign. The Campaign Confirmation may document matching fields or a lookback period. If it does not, a later record matched to the same person, household, or property within 30 days after the first billable submission is a duplicate and is not separately billable.
- Service Area
- The ZIP codes or other geographic boundaries approved by the Customer before calling begins, as updated through an accepted campaign change.
A match is an automated or data-assisted determination and may not be perfect. A Qualified Homeowner Lead is a billing and workflow definition; it is not a warranty that the person needs a service, will answer, has consented to every form of contact, will book, or will buy.
Campaign setup and changes
Before launch, Customer will provide or approve the website, pages, service area, seller identity, offer, script, calendar or handoff instructions, and applicable suppression data. Changes that materially affect scope, risk, or cost may require a revised Campaign Confirmation. If documents conflict, a signed agreement or Campaign Confirmation controls for the specific campaign, then these Terms, then general website copy.
3. Billing, taxes, and lead disputes
Customer authorizes Phone Staffer and its payment provider to charge the payment method approved for the campaign. Unless the Campaign Confirmation states otherwise, weekly invoices cover the Qualified Homeowner Leads recorded during the prior billing period. Amounts are stated in U.S. dollars. Customer is responsible for applicable sales, use, withholding, or similar taxes other than taxes based on Phone Staffer's net income.
If Customer reasonably believes a charged record did not satisfy the qualification rules, it should email hello@phonestaffer.comwithin 30 days of the invoice and identify the record and reason. Phone Staffer will review available matching and campaign data. If the record was a bot, test, outside-area, duplicate, materially bad match, wrong person, or otherwise did not meet the agreed criteria, Phone Staffer will issue an appropriate credit or correction. A person not answering, declining the offer, having no current project, not booking, or not becoming a sale is not, by itself, grounds for a credit because those outcomes do not change whether the record met the qualification rules when submitted. This process does not limit rights that cannot lawfully be waived.
Customer must keep billing information current. Phone Staffer may pause services for overdue or failed payments after reasonable notice. Except for verified billing errors, service credits stated in an agreement, or non-waivable rights, fees for services already provided are not refundable.
4. Cancellation, suspension, and termination
Unless a Campaign Confirmation states a committed term, Customer may cancel the $1 calling-only offer before the next weekly billing period by written notice. Charges accrued before the effective cancellation date remain payable. Customer should coordinate removal or disabling of campaign scripts and integrations after cancellation.
Either party may terminate for a material breach not cured within a reasonable period after notice, or immediately when continued performance would create a credible legal, security, privacy, fraud, safety, or reputation risk. Phone Staffer may also suspend an affected campaign while investigating such a risk. Provisions intended by their nature to survive, including fees, confidentiality, data restrictions, disclaimers, liability, indemnity, and general terms, survive.
5. Customer responsibilities
Customer is responsible for:
- Owning or being authorized to control each website, domain, account, script placement, CRM, calendar, and data source used for the campaign.
- Providing accurate business identity, licenses, service area, pricing, claims, scripts, and fulfillment information.
- Publishing privacy, cookie, and other notices appropriate to the Customer's website and processing, and obtaining choices or consent where required.
- Ensuring Customer instructions, offers, data, and intended uses are lawful and do not infringe another person's rights.
- Maintaining and promptly supplying relevant do-not-call, do-not-contact, customer-specific, or other suppression records.
- Reviewing leads and call output, securing Customer accounts, and notifying Phone Staffer promptly of errors, unauthorized access, or changed instructions.
- Substantiating objective advertising claims and honoring appointments, quotes, promotions, and commitments made to consumers.
Customer may not use the services for unlawful surveillance, harassment, discrimination, deception, sensitive eligibility decisions, or to identify or target people based on health, precise location, children, financial hardship, or another sensitive category without a written scope and an appropriate legal basis. Phone Staffer may reject or restrict a use case without determining that every other use is legally permitted.
6. Calling and communications requirements
Depending on campaign facts, Customer may be treated as a seller and Phone Staffer may be treated as a telemarketer or service provider. Each party remains responsible for obligations applicable to its role under the Telephone Consumer Protection Act, Telemarketing Sales Rule, federal and state do-not-call rules, call-recording laws, state telemarketing laws, and similar requirements. These Terms are not legal advice and configuration of the service does not itself establish compliance.
A website visit, identity match, property match, or available telephone number does not by itself prove consent, an inquiry, an established business relationship, or permission to use an automatic telephone dialing system, artificial voice, prerecorded voice, or text message. Customer must identify the permitted contact basis and technology for each campaign. Unless expressly agreed in writing, the website-lead calling offer does not authorize artificial or prerecorded voice calls or marketing text messages.
Campaigns must use accurate seller identification, appropriate caller ID, permissible calling times, required disclosures, and effective do-not-call procedures. Customer and Phone Staffer will reasonably cooperate to route and honor opt-out requests, investigate complaints, and preserve records required for the campaign. A consumer must not be required to hear a sales presentation before a do-not-call request is accepted.
7. Data, privacy, and security
Our Privacy Policy describes Phone Staffer's own website and business practices. When Phone Staffer processes campaign data under Customer instructions, Customer determines the permitted business purpose and is responsible for its notices and legal basis. A separate data processing addendum or signed agreement controls if applicable.
Customer grants Phone Staffer a limited right to host, copy, transmit, transform, and otherwise process Customer data as reasonably necessary to provide, secure, support, bill for, and improve the contracted services; prevent abuse; and meet legal obligations. Phone Staffer may use aggregated or de-identified information that is not reasonably linkable to an individual or Customer, subject to contractual and legal restrictions.
Each party will use reasonable administrative, technical, and organizational safeguards appropriate to the information it controls. No service is completely secure. Customer must not send highly sensitive information unless the parties have approved the use case and safeguards in writing.
8. Third-party services
Services may interoperate with hosting, identity, data, calling, CRM, calendar, analytics, advertising, payment, or other third-party tools. Third-party services may have separate terms, fees, availability, and privacy practices. Phone Staffer is not responsible for an independent third party's acts or systems, but this does not excuse Phone Staffer from duties that applicable law or a signed agreement places on it.
9. Results, reports, and testimonials
Lead matching, answer rates, appointments, and sales depend on traffic, match availability, geography, offer, season, script, calling rules, customer response, and other factors outside Phone Staffer's control. Unless a signed agreement expressly says otherwise, Phone Staffer does not guarantee a match rate, number of leads, answer rate, appointment, revenue, or return on investment.
Testimonials, examples, lead reports, and performance figures describe particular campaigns or illustrative scenarios. They are not promises that every Customer will obtain the same result. Phone Staffer should maintain a reasonable basis for objective claims it publishes; Customer is responsible for claims and testimonials it supplies or directs Phone Staffer to use.
10. Intellectual property and confidentiality
Phone Staffer and its licensors retain rights in the website, service, workflows, software, templates, and general know-how. Customer retains rights in Customer data, trademarks, scripts, offers, and materials it supplies. Neither party receives ownership of the other party's property except for limited rights needed to perform the agreement.
Each party will protect non-public business, technical, pricing, customer, and campaign information received from the other and use it only for the agreement, except when disclosure is authorized or reasonably required by law. Confidentiality does not cover information that is public without breach, independently developed, rightfully received without restriction, or already known without a duty of confidence.
11. Disclaimers
To the maximum extent permitted by law, the website and services are provided "as is" and "as available." Phone Staffer disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Phone Staffer does not warrant that every data match is accurate, that services will be uninterrupted, or that use of the services will satisfy every law applicable to Customer's business. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
12. Limitation of liability and indemnity
To the maximum extent permitted by law, neither party will be liable to the other for indirect, incidental, special, exemplary, punitive, or consequential damages, or lost profits, revenue, goodwill, or data, arising from the services, even if advised of the possibility. Phone Staffer's aggregate liability arising from a campaign will not exceed the fees paid or payable for that campaign during the three months before the event giving rise to the claim.
These limits do not apply to liability that cannot lawfully be limited and do not limit Customer's payment obligations. A signed agreement may state different limits for a particular service.
Customer will defend and indemnify Phone Staffer and its personnel from third-party claims, damages, penalties, and reasonable costs arising from Customer data, instructions, offers, products, unlawful campaign use, breach of these Terms, or violation of another person's rights, except to the extent caused by Phone Staffer's own breach, negligence, or willful misconduct. Phone Staffer will provide reasonable notice and cooperation, and Customer may not settle a claim in a way that admits fault or imposes obligations on Phone Staffer without consent.
13. Governing terms and general provisions
The governing law, forum, and any agreed dispute process stated in a signed agreement or Campaign Confirmation control. If no such provision exists, applicable law and ordinary conflict-of-law rules determine those issues; these Terms do not select a jurisdiction that has no reasonable connection to the parties or transaction. Before filing a business dispute, the parties should attempt in good faith to resolve it through written notice and direct discussion, unless urgent relief or a non-waivable right applies.
Neither party is liable for delay caused by events beyond its reasonable control, except payment obligations. Customer may not assign the agreement without Phone Staffer's consent, not to be unreasonably withheld; Phone Staffer may assign it in connection with a reorganization, financing, or sale of the relevant business. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue. A waiver must be explicit and does not waive a later breach.
These Terms, the Campaign Confirmation, and any signed agreement or data processing addendum form the entire agreement for the service and replace prior discussions on that subject. Headings are for convenience. Electronic notices and signatures may be used where permitted.
14. Changes to these Terms
We may update these Terms prospectively as services or requirements change. The effective date above identifies the current version. Material changes to an active paid campaign will apply as permitted by the applicable agreement and after notice reasonably suited to the change; posting new Terms does not retroactively rewrite an already signed agreement.
